Welcome to OmniVid (https://www.omnivid.ai, the "Site"). These Terms ("Terms") form a legally binding agreement between you ("User," "you") and OmniVid ("Company," "we," "our") regarding your access to and use of our AI video generation service (the "Service").

Read carefully. By creating an account, purchasing a plan, or uploading content, you accept these Terms. If you do not agree, do not use the Service.

1. Service Description

OmniVid is an all-in-one AI video generation platform that enables Users to submit prompts—text, images, audio, or video—and automatically generate videos ("Generated Videos") using multiple state-of-the-art AI models from various providers, including but not limited to Seedance 2.0, Sora 2, Veo 3.1, and other leading video generation models.

2. Accounts

  • Sign in via Google OAuth 2.0.
  • Keep credentials confidential; you are responsible for all activity under your account.
  • We may suspend or terminate accounts that violate these Terms or applicable law.

3. Subscriptions & Auto-Renewal

  • We offer Starter, Pro, and Ultimate plans.
  • Each plan can be purchased on a monthly or annual billing cycle.
  • Every plan grants a different quota of credits, storage space, support level, and (where applicable) commercial-use rights.
  • Full plan details are shown on the Pricing page and may change with 15-days' notice.
  • Auto-Renewal: All subscriptions automatically renew at the end of each billing cycle. By subscribing, you authorize us to charge your payment method at the then-current rate on each renewal date. You may cancel auto-renewal at any time via Settings → Billing in your account dashboard. If you do not cancel before the renewal date, you are deemed to have agreed to continue the subscription for the next billing cycle.

3.1 Credits & Expiration

  • Monthly subscriptions – Credits are allocated at the start of each billing cycle and expire at the end of that cycle (i.e., the next renewal date). Unused credits do not roll over to the next month.
  • Annual subscriptions – The full annual credit quota (including any bonus credits) is allocated upfront at the start of the subscription and expires at the end of the annual billing cycle. If you cancel, credits remain available until the end of the current paid period.
  • One-time credit packs – Credits purchased as one-time packs do not expire and remain in your account until used.
  • Credits are non-transferable and have no cash value. We do not provide refunds or exchanges for unused credits except as described in our Subscription & Refund Policy.

4. Acceptable Use

You must not use the Service to:

  1. Generate or share unlawful, violent, sexual, hateful, harassing, or deceptive content.
  2. Violate third-party intellectual-property, privacy, or publicity rights.
  3. Mislead others into believing Generated Videos are real recordings.
  4. Reverse-engineer or scrape our models or infrastructure.
  5. Bypass usage limits or security mechanisms.

4.1 User Content Requirements

You are solely responsible for ensuring that all materials you upload ("User Content") comply with applicable laws and do not infringe upon any third party's rights. In particular:

  • Intellectual Property – You must not upload images, videos, audio, or other materials that infringe third-party copyrights, trademarks, or other intellectual-property rights. You must own or have obtained all necessary licences and permissions for any content you upload.
  • Real Human Likenesses – If your User Content contains photographs, videos, or other depictions of real, identifiable individuals, you must have obtained written consent from each depicted person (or their legal guardian) authorizing the use of their likeness for AI video generation. You bear full responsibility for any claims arising from the unauthorized use of a person's likeness.
  • Prohibited Subject Matter – You must not upload content depicting minors, non-consensual imagery, or any material that violates our Acceptable Use rules above.

We reserve the right to review content (human or automated) and remove or block anything that breaches these Terms.

4.2 Ultimate Plan – Fair Use Policy

For subscription tiers that include unlimited access to certain AI models ("Unlimited Access"), the following conditions apply:

  • Unlimited Access is provided exclusively for normal, human-directed use. This means you personally initiate and review each generation request through our standard interface.
  • Our automated risk-control systems continuously monitor usage patterns. If we detect activity indicative of abuse, automation, scripting, bot-driven requests, or other non-human usage, we may temporarily suspend your access pending review.
  • Temporary suspension is a protective measure designed to ensure fair and reliable service for all Users. If our review concludes that no violation occurred, access will be promptly restored.
  • Repeated or severe violations of this Fair Use Policy may result in permanent suspension or termination of your account without refund.

5. Intellectual Property

5.1 User Content

You retain ownership of the content you upload ("User Content"). You grant OmniVid a worldwide, non-exclusive, royalty-free licence to use, reproduce, modify, and process User Content solely to provide and improve the Service.

5.2 Generated Videos

Subject to payment and compliance with these Terms:

  • Personal Use – You may download, share, and publicly display Generated Videos for non-commercial purposes (social media, portfolios, personal projects). Attribution is appreciated but not mandatory.
  • Commercial Use – If you require commercial rights (e.g., advertising, paid content, resale), choose a subscription tier that includes commercial-use rights or purchase an add-on that grants such rights.
  • Generated Videos are not guaranteed to be unique; similar outputs may be produced for other Users.

7. Warranty Disclaimer

The Service is provided "AS IS." We make no guarantees regarding availability, accuracy, or fitness for a particular purpose. Generated Videos may contain artefacts or imperfect lip-sync.

Feature Limitations: Some features and capabilities may vary depending on the AI model used for generation. Certain models may have beta or experimental features that are subject to limitations. There is a possibility that generated videos may lack certain features, have incomplete functionality, or contain artifacts. We do not provide refunds, credits, or compensation for variations in output quality or feature availability across different AI models.

8. Indemnity

You agree to indemnify and hold OmniVid harmless from any claim arising out of your User Content, Generated Videos, or breach of these Terms.

9. Changes

We may update these Terms at any time. Material changes become effective 15 days after posting. Continued use constitutes acceptance.
